Shipping

We ship using UPS or FedEx. Please contact us if you require special shipping terms. For credit card orders, a copy of the credit card receipt and paid purchase order will be enclosed with the shipment. We usually ship the same day we receive your order if we receive it before 2:00 PM central time Monday through Thursday. No shipping Fridays, Saturdays, or Sundays. To ensure that a late-placed rush order gets shipped on the same day it is received; we recommend you call us and let us know your order is hot. If there is a delay in filling your order we will attempt to notify you.

International Orders

All orders of international origin are exported from the U.S. in accordance with Export Administration Regulations. All taxes, duties, insurance, shipping charges, and other international charges and fees are the responsibility of the customer. Terms of payment for export orders are credit card or bank funds transfer and payment must be made prior to shipping.

Return Policy

If you need to return a product to Microflex, for repair or credit, please contact us for an RMA (Return Materials Authorization) number first. This number will help track your product. We may need to ask additional questions to ensure you get the service you need. Most of our products carry a 1 year warranty. Check your product manual for warranty details.

Privacy Policy

Microflex, LLC, owns and operates this web site and we are the sole owner of the information collected on this web site. We will not sell, share, or rent this information to a third party in any way other than as disclosed in this privacy policy. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities and may, in our sole discretion, disclose personal information or other information to satisfy any law, regulation, subpoena, or government request. We reserve the right to release personal information or other information about users who we believe are engaged in illegal activities or are otherwise in violation of our Terms of Service, even without a subpoena, warrant or court order, if we believe, in our sole discretion, that such disclosure is necessary or appropriate to operate our web site or to protect the rights or property of Microflex, LLC, our affiliates, or our officers, directors, employees, agents, third-party content providers, suppliers, sponsors, or licensors. We also reserve the right to report to law enforcement agencies any activities we reasonably believe in our sole discretion to be unlawful. If we are legally compelled to disclose information about you to a third party, we will attempt to notify you by sending an email to the email address in our records unless doing so would violate the law or unless you have not provided your email address to us.

Terms of Payment

If credit has been granted, payment is net 30 days from date of invoice. All payments must be made without set-off or deduction. Orders are subject to credit approval by Microflex, LLC, which may in its sole discretion at any time change the terms of customer's credit or require advance payment or payment by official bank check. If Microflex, LLC reasonably believes that a customer's ability to make payments is impaired, Microflex, LLC may cancel any order or remaining balance thereof, and the customer will remain liable to pay Microflex, LLC for products already shipped. Customer will submit such financial information as Microflex, LLC may reasonably require for determination of credit terms. Checks are accepted subject to collection and the date of collection will be deemed the date of payment. Any payment received from a customer may be applied by Microflex, LLC against any obligation owing by a customer to Microflex, LLC under this or any other contract, regardless of any statement appearing on or referring to such payment, without discharging a customer's liability for any additional amounts owing by a customer to Microflex, LLC. The acceptance by Microflex, LLC of such payment will not constitute a waiver of Microflex's right to pursue the collection of any remaining balance. If a customer fails to make payment when due, without prejudice to any other right or remedy, (i) overdue sums will bear interest to date of payment at the annual rate of 18% or such lower rate as may be the maximum permitted by law; and (ii) Microflex, LLC will be entitled to reimbursement for all costs of collection and attorneys' fees. Credit cards accepted are MasterCard, Visa, and American Express. For bank funds wire transfer, contact us for our bank details.

Limitation of Liabilities

CUSTOMER SHALL NOT BE ENTITLED TO, AND MICROFLEX, LLC SHALL NOT BE LIABLE FOR, LOSS OF PROFIT, PROMOTIONAL OR MANUFACTURING EXPENSES, OVERHEADS, BUSINESS INTERRUPTION COSTS, LOSS OF DATA, REMOVAL OR REINSTALLATION COSTS, INJURY TO REPUTATION OR LOSS OF CUSTOMERS, PUNITIVE DAMAGES, IPR INFRINGEMENT, LOSS OF CONTRACTS OR ORDERS OR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE. CUSTOMER'S RECOVERY FROM MICROFLEX, LLC FOR ANY CLAIM SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THE AFFECTED PRODUCTS IRRESPECTIVE OF THE NATURE OF THE CLAIM WHETHER IN CONTRACT, TORT, WARRANTY, OR OTHERWISE.

Limitations of Use

PRODUCTS SOLD BY MICROFLEX, LLC ARE NOT RECOMMENDED OR AUTHORIZED FOR USE IN LIFE SUPPORT, SURGICAL IMPLANTATION, NUCLEAR OR AIRCRAFT APPLICATIONS OR FOR ANY USE OR APPLICATION IN WHICH THE FAILURE OF A SINGLE COMPONENT COULD CAUSE SUBSTANTIAL HARM TO PERSONS OR PROPERTY. Customer agrees that using or selling Products for use in such applications is done at its own risk, and agrees that Microflex, LLC is not liable for any claim or damage arising from such use. Customer agrees to fully indemnify, defend and hold harmless Microflex, LLC from and against any and all claims, damages, loss, cost, expense or liability arising out of or in connection with the use or performance of Products in such applications. Use of software will be subject to the terms of any accompanying end user license.
